These Conditions of Service ("Terms") constitute a legally binding agreement between you and Hasanudin ("Cycle Chat," "we," "us," or "our") governing your access to and use of the Cycle Chat website ("Site"), mobile application ("App"), and all associated content, tools, features, and services made available through them (collectively, "the Services"). Please read these Terms carefully, as they affect your legal rights and obligations.

By accessing, downloading, installing, or using any portion of the Services, you affirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not accept these Terms, you must not access or use the Services. These Terms apply to all users, visitors, and others who access or use the Services, regardless of the device or platform used.

Book First: Scope and Eligibility

1. Coverage

These Terms cover all access to and use of the Site and the App. References to "Cycle Chat" include the Company and its successors and assigns. The term "Services" encompasses all current and future features, functionalities, and offerings provided through the Site and App. The terms "you," "your," and "user" refer to any individual or entity that accesses or uses the Services.

2. Age Requirements

The App is rated 18+ and may only be downloaded and used by individuals aged eighteen (18) years or older, in compliance with applicable app store standards. This age requirement applies to all functionalities, including in-app purchases and social interaction features.

You represent and warrant that you meet the applicable age requirement for your platform. We do not assume responsibility for inaccurate age information provided by users, as we lack the means to independently verify age.

3. No Use by Minors

If you do not meet the applicable age requirement, you may not access or use the Services, even with the consent or supervision of a parent or legal guardian.

4. Use on Behalf of an Organization

If you access or use the Services on behalf of a company, organization, or other entity, "you" includes both you and that entity. You represent and warrant that you are an authorized representative with the legal authority to bind the entity to these Terms, and you agree to these Terms on behalf of the entity.

Book Second: AI-Generated Content and Disclaimers

5. User Control Over Generated Content

All images, avatars, conversational outputs, and other AI-generated content produced through the Services are created in response to your inputs and prompts. Cycle Chat does not prescreen all content in advance; however, Cycle Chat does review and moderate content through automated safety filters, human review of reported content, and the enforcement measures described in these Terms, and reserves the right to remove content and to suspend or terminate accounts that violate these Terms. You acknowledge that AI-generated outputs may vary in quality, accuracy, appropriateness, and reliability.

6. User Responsibility

You bear sole and complete responsibility for ensuring that any content you create, save, share, or distribute through the Services, whether user-generated or AI-generated, is lawful, non-infringing, and appropriate for its intended audience and distribution channel. You assume all risks associated with the accuracy, legality, and appropriateness of content you generate or share.

7. Platform Liability Limitation

Cycle Chat shall not be liable for any consequences arising from the creation, storage, distribution, or public sharing of content produced using the Platform. This includes, without limitation, any inappropriate, offensive, infringing, defamatory, or unlawful material generated or disseminated by you or other users.

8. Watermark and Branding

The presence of the Cycle Chat watermark, logo, or branding on shared content does not imply that Cycle Chat created, approved, endorses, or supports such content. Such marks serve solely as product identifiers and do not constitute an endorsement of any kind.

All characters available through the Services are artificial intelligence constructs and are not real persons, and nothing a character says should be understood as a statement by a real individual. AI-generated outputs do not constitute medical, psychological, legal, financial, or other professional advice, and no character holds any professional license or qualification. You should not rely on AI-generated content as a substitute for advice from qualified professionals.

9. Content Moderation Limitations

While Cycle Chat employs automated moderation tools, safety filters, or other screening mechanisms, these systems are not guaranteed to detect all inappropriate, harmful, or prohibited content. You must exercise caution and sound judgment before sharing any media or content generated through the Services.

10. Assumption of Risk

By generating, sharing, or distributing content through Cycle Chat, you expressly assume all risks related to the accuracy, appropriateness, legality, and distribution of such content, and you release Cycle Chat from any claims arising therefrom.

Book Third: Account Registration and Security

11. Registration Methods

To access and use certain features of the Services, you must register for an account. You may register using an Apple ID or Google account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

12. Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account or any other security breach. You must not share, lend, or transfer your account credentials to any third party.

13. False Age Information

If you circumvent age requirements by providing false information, we reserve the right to suspend or terminate your account upon discovery and may pursue appropriate legal remedies. We may request reasonable proof of age at any time and will terminate any account we reasonably believe to be operated by a minor.

14. Cooperation with Platform Partners

We reserve the right to investigate suspected violations of these Terms and to suspend Services until appropriate action is taken, including coordination with our platform partners (such as Apple and Google).

Book Fourth: User Obligations and Prohibited Conduct

15. General Obligations

You may use the Services only in accordance with these Terms and all applicable laws and regulations. You agree to assume full responsibility for all actions and omissions that occur as a result of your use of the Services.

16. Prohibited Activities

You agree not to engage in any of the following activities:

Impersonating any person or entity, or misrepresenting your affiliation with any person or entity;

•

Using the Services to create "deep fakes," impersonations, political misinformation, fraudulent content, or material that damages the reputation of third parties;

•

Copying, distributing, or disclosing any part of the Services, including through automated or manual "scraping" techniques;

•

Using any automated system (including robots, spiders, offline readers) to access the Services;

•

Transmitting spam, chain letters, or other unsolicited communications;

•

Interfering with or compromising the integrity or security of the Services, or decrypting transmissions to or from our servers;

•

Imposing an unreasonable or disproportionate load on our infrastructure;

•

Uploading invalid data, viruses, worms, or other harmful software agents;

•

Using the Services for commercial solicitation purposes without our prior written consent;

•

Accessing content through unauthorized means or bypassing any access restrictions we implement.

17. Prohibited Content

You are solely responsible for all content you submit to the Services. You agree not to submit any content that:

•

Infringes any intellectual property or other proprietary rights of any party;

•

Contains viruses or malicious code designed to disrupt or damage software, hardware, or telecommunications equipment;

•

Creates a privacy or security risk to any individual;

•

Constitutes unsolicited advertising, spam, chain letters, pyramid schemes, or other unauthorized solicitations;

•

Is threatening, abusive, harassing, tortious, bullying, or excessively violent;

•

Is defamatory, libelous, or verifiably false with intent to harm;

•

Constitutes hate speech or promotes discrimination or violence based on protected characteristics;

•

Is obscene, pornographic, or constitutes sexual harassment;

•

Constitutes sexual exploitation or abuse of minors, including child sexual abuse material, grooming, or sexual extortion;

•

Glorifies self-harm, suicide, or eating disorders;

•

Promotes terrorism or violent extremism;

•

Facilitates criminal activity or the sale of illegal drugs;

•

Facilitates automated decision-making adversely affecting legal rights;

•

Constitutes unauthorized professional advice (medical, legal, financial, or tax);

•

Interferes with or disrupts the Services or connected networks;

•

Infringes upon any person's right of publicity; or

•

Is, in our sole judgment, objectionable or harmful to users or the Platform.

18. Enforcement

We reserve the right to investigate and take appropriate action against any user we determine, in our sole discretion, to have violated these provisions. Such action may include removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities. If you believe another user has violated these Terms, please contact us at [email protected].

Cycle Chat maintains a zero-tolerance policy toward objectionable content and abusive users. Content or conduct prohibited by Sections 16 and 17 or by our Child Safety Policy has no place on the Services, and egregious or repeated violations will result in immediate and permanent termination of the offending account.

You may report objectionable content or abusive users at any time without leaving the App: (a) every AI-generated reply includes its own report entry — when you report a reply, the full text of that reply is automatically attached to your report so that our moderation team can review the exact content at issue; (b) every AI character profile includes a report entry covering the character as a whole, including its persona, avatar, and introductory content; and (c) you may report a user account from that user's profile or from content they have created. You may also report by contacting us at [email protected].

We review all reports of objectionable content or abusive behavior promptly, and in any event within twenty-four (24) hours of receipt. Where a report is substantiated, we will remove the offending content and suspend or permanently terminate the account of the user responsible. Confirmed child sexual abuse or exploitation material will additionally be reported to the National Center for Missing & Exploited Children (NCMEC) or the competent authority in the relevant jurisdiction, as described in our Child Safety Policy.

Book Fifth: Payment and Subscription Terms

19. Paid Features

Certain features of the Services are available for purchase through in-app transactions. All payments are processed through the applicable app store (Apple App Store or Google Play) and are subject to their respective terms and conditions.

20. Fees and Currency

Currency conversion, foreign exchange fees, and payment processing fees are determined by your agreement with the respective payment provider and are beyond our control.

21. Refund Policy

All in-app purchases are final and non-refundable. Once a transaction is completed, it cannot be reversed or refunded regardless of change of mind or circumstances. You waive any rights to cancel completed purchases or obtain refunds to the extent permitted by applicable law.

22. Pricing Changes

We reserve the right to modify the prices of virtual goods and services at any time without prior notice. Price changes will not affect any purchases already completed.

23. Purchase Limitations

In-app purchases are not redeemable for cash, legal tender, or currency of any jurisdiction. In-app purchases may only be used within the Services provided by Cycle Chat and may not be combined with other promotions unless expressly stated. If your account is suspended or terminated, you forfeit any purchased virtual items without entitlement to compensation.

Book Sixth: Intellectual Property

24. Your Content

When you submit content to the Services, you represent and warrant that you own all rights in and to such content or have obtained all necessary licenses and authorizations. By creating, uploading, or sharing any content through the Services (including AI characters and related materials), you confirm that you have read and affirmatively accepted these Terms. You retain ownership of any content you submit, but you grant Cycle Chat a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual, irrevocable license to use, reproduce, display, distribute, modify, adapt, and commercialize such content in connection with operating, improving, and providing the Services.

25. Characters and Generations

When you create AI characters using the Services, you retain ownership of those characters as between you and Cycle Chat, subject to the license granted herein. You also own any text, images, audio, or video generated by those characters in response to your inputs. You grant Cycle Chat a comparable license to use such characters and generations for any purpose, including facilitating interactions between other users and your characters and promoting the Services.

26. Our Intellectual Property

You acknowledge that the Services may contain content and features protected by copyright, patent, trademark, trade secret, and other proprietary rights. You may not use data mining, robots, scraping, or similar automated data gathering methods. If we block your access, you may not circumvent such blocking. Any use of the Services beyond what is expressly authorized is strictly prohibited.

27. Trademarks

All trademarks displayed through the Services are the property of their respective owners. Nothing in these Terms grants you any license to use Cycle Chat's trademarks without our prior written permission.

28. Third-Party Content

Cycle Chat is not responsible for third-party content, including characters created by other users and their generated outputs. You acknowledge that AI-generated content is inherently unpredictable and may be inaccurate or offensive. You must evaluate and bear all risks associated with using any content or generations available through the Services.

29. Content Removal

We reserve the right, but not the obligation, to remove any content that violates these Terms or that we deem objectionable in our sole discretion.

30. Feedback

Any feedback, suggestions, or ideas you provide regarding the Services are non-confidential, and we may use and disseminate them for any purpose without compensation or acknowledgment.

Book Seventh: Copyright Protection

31. Copyright Infringement Claims

Cycle Chat respects the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please notify us in accordance with the following procedure.

32. DMCA Notification Requirements

Your notification must be in writing and include: (a) your electronic or physical signature as the person authorized to act on behalf of the copyright owner; (b) a detailed description of the copyrighted work or intellectual property you believe has been infringed; (c) the location of the allegedly infringing material on our Services; (d) your contact information; (e) a statement of your good faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

33. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act and applicable law, we will terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are repeat infringers.

Book Eighth: Privacy

Your use of the Services is also governed by our Privacy Policy. By accepting these Terms, you acknowledge that you have read and understood our privacy practices. We may amend the Privacy Policy at any time by posting updates. Your continued use of the Services following such amendments constitutes your acceptance.

Book Ninth: Third-Party Services

The Services may contain links to third-party websites, services, or advertisements. We are not responsible for the content, accuracy, functionality, or privacy practices of these external services. All interactions with third-party advertisers or services are solely between you and the respective third party. We are not liable for any loss or damage arising from such dealings or from the presence of such advertisers on the Platform.

34. General Disclaimer

YOU USE THE SERVICES AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

35. No Guarantee of Uninterrupted Service

We do not guarantee that the Services will always be safe, secure, error-free, or uninterrupted. We make no warranty that: (a) the Services will meet your requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) results obtained from using the Services will be accurate or reliable; (d) the quality of any products, services, or information obtained will meet your expectations; or (e) any errors in the software will be corrected.

36. Download Risk

Any content or material downloaded or otherwise obtained through the Services is at your own discretion and risk. You are solely responsible for any damage to your device or computer, loss of data, or other harm resulting from such downloads.

Book Eleventh: Limitation of Liability

37. Release

You release Cycle Chat, its subsidiaries, affiliates, and each of their directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any other user or third party in connection with the Services.

38. Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

39. Applicable Law Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our warranties and liabilities will be limited to the maximum extent permitted by applicable law.

Book Twelfth: Indemnification

You agree to defend, indemnify, and hold harmless Cycle Chat and its affiliates from and against any claims, liabilities, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms.

Book Thirteenth: Termination

These Terms take effect when you begin using the Services and continue until terminated by either party. We reserve the right to change, suspend, or discontinue the Services or any part thereof at any time without notice. These Terms will terminate automatically if you fail to comply with any provision herein. Upon termination, you must immediately cease all use of the Services and any associated intellectual property.

Book Fourteenth: Changes to Terms

We may modify these Terms at any time at our sole discretion. Changes will be posted on this page and become effective upon posting. It is your responsibility to review these Terms periodically. By continuing to access or use the Services after changes are posted, you agree to the updated Terms. If you do not agree, you should immediately cease using the Services. We may notify you of significant changes via email or in-app notifications, but you remain responsible for staying informed of any updates.

40. Severability

If any provision of these Terms is held to be illegal, invalid, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

41. Entire Agreement

These Terms constitute the entire agreement between you and Cycle Chat concerning the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings.

42. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Cycle Chat.
